Service Provider Identity
This document regulates the terms under which Misael Marín, artistically known as Xixsael, an independent music producer based in Anzoátegui, Venezuela, offers music production services through his official website and other authorized channels.
Services Offered
Services include music creation, mixing, and mastering in genres such as Progressive House, Slap House, Piano House, Rally House, Drum & Bass, Reggaeton, Afro House, Trap, Deep House, Big Room, Brazillian Phonk, Drift Phonk, Phonk, and Tech House.
Available Packages
The producer offers three packages: Starter at 100 USD, Pro at 300 USD, and Premium at 500 USD. Each package includes specific features regarding production complexity, level of detail, and final delivery.
Hiring Modalities
The client may choose between two hiring modalities: a one-time payment for music production, or a royalty agreement in which revenue distribution derived from the exploitation of the work will be contractually defined.
Formal Contract
Every project will be governed by a legal contract that specifies the agreed conditions, such as full transfer of commercial rights or royalty distribution, as well as deadlines and responsibilities of both parties.
Intellectual Property
Until contractual and payment obligations are fully met, all copyright and intellectual property rights of the produced work will remain the exclusive property of the producer.
Transfer of Commercial Rights
In the case of a full rights transfer, the client will become the sole holder of the commercial rights of the work, being able to exploit it without restrictions. In royalty-based agreements, the contract will specify the percentage corresponding to each party.
Use of Productions
The client agrees not to publish, distribute, or monetize the work before signing the contract and completing the full payment. Any violation of this clause will be considered unauthorized use of intellectual property.
Work Process
To initiate a project, the client must complete a form providing details of the desired production, followed by direct communication with the producer to define references, objectives, and specific requirements.
Advance Payment and Balance
The project requires a 50% advance payment, invoiced by the producer, before work begins. The remaining 50% must be paid upon completion and delivery of the project.
11. Payment Methods
Payments must be made via bank transfer or other previously authorized methods. The producer guarantees that an invoice will be issued for each transaction, ensuring transparency and legal backing.
Project Delivery
Delivery times vary depending on project complexity, the package chosen, and existing workload. Deadlines will be communicated and agreed upon with the client prior to starting the project.
Service Guarantee
The producer guarantees that each project will be carried out in a professional and personalized manner, according to the client’s instructions. However, as this is a creative service, absolute satisfaction of subjective expectations cannot be guaranteed.
Refund Policy
If the client is not satisfied with the final result, only the 50% advance will be refunded. Once the project is finalized and the remaining balance is paid, no refunds or returns will be issued.
Limited Liability
The producer will not be held responsible for the commercial performance, success, or failure of the work on digital platforms, live events, or sales. Use and commercial exploitation remain the sole responsibility of the client.
Confidentiality
All information and materials provided by the client will be treated with strict confidentiality. The producer will not disclose or use this information for purposes unrelated to the contracted project.
Modifications and Revisions
The number of revisions included depends on the package purchased. Additional revisions may incur extra costs, which will always be communicated to the client in advance.
Project Cancellation
The producer reserves the right to cancel projects in cases of non-payment, unauthorized use of the work, false information provided by the client, or any violation of these terms.
Updates to Terms
These Terms and Conditions may be updated periodically without prior notice. It is the client’s responsibility to review them on the official website before hiring any services.
Client Acceptance
By hiring any of the services offered by Xixsael, the client declares that they have read, understood, and fully accepted these Terms and Conditions, acknowledging their validity and enforceability.
